Terms of Use

We, the sole proprietor and administrator (to be called 'we') of the site kidzcard.nl, state our terms of use in this document. Users of the site kidzcard.nl and its services (site and services together to be called 'the site'), accept all of the following terms, conditions and limitations by using the site:

Intended use

Intended use of this site is as follows:

• The site offers its users the possibility of sending a link to a personalized electronic card (e-card) regarding one of the presented themes to a recipient per e-mail.
• The site is intended for personal use only, thus prohibiting use by any commercial entity or party or the like.
• The site is only intended for recreational, entertainment purposes and should not be used for any other purpose.
• The site offers its service at no cost to the user.
• A contact e-mail adress is made available on the site, that a user may use to report any problems regarding the site. We will handle such issues on a "best effort" basis, with no guarantees whatsoever regarding quality, timeliness and effectiveness of a solution.

Limitations of service

Given the intended use described above, the followings limitations apply:

• We strongly advice against any use of the site other than the intended use as stated above. However, the user is solely responsible for adhering to the intended use, as we have no means to enforce this use.
• We accept no liability of any kind for direct or indirect damage that may occur by using the site.
• The site is built and maintained on a 'best-effort' basis and with limited resources. If you want any guarantees, this site is not suitable for your use.
• We have built and tested the site with reliability and security (and fun) in mind, however this poses no guarantees whatsoever.
• The user is aware, and is made aware in the e-card creation process, that using the site to send an e-card poses no guarantee that the card will reach the recipient, nor that a recieved card reaches the recipient in the form intended by the sender, nor that the processing or transmission is free of other errors.
• We grant ourselves the right to remove a card from our database and/or our Hall Of Fame if we consider it inappropriate given the purpose of the site, or if it conflicts with public interest, to be determined at our discretion.

Privacy

• We will not, by any means, use, store or pass on the supplied e-mail adresses for any use other than delivering your e-card to the adressee.
• In the card creation process, the user must explicitly select the (initially deselected) option to publish the front (picture) side of his/her e-card on the publicly accessible KidZcard Hall Of Fame.
• The contact e-mail adress made available on the site may be used to ask for a card to be removed from the Hall of Fame.

Copyright

• For some e-cards we use third party images. These images were published as free of copyright and royalties by the people publishing them. If you find any image however, that you deem is protected by copyrights, we ask you to inform us by contact e-mail, so we can sort out the issue.
• We pose no claims on copyright of the e-card images created by our site, we consider them free of copyright.
